Event Participation Waiver and Release

As an invited guest of Polaris to the Regional VIP Experience Weekend trip and by completing this registration, you and your guest acknowledge that attending this event involves possible risks. Please review this release and accept the terms by checking the appropriate boxes below.

GENERAL RELEASE OF ALL CLAIMS

By signing this General Release, I hereby acknowledge that I have voluntarily elected to participate in various events as part of the VIP Weekend in Kohler, WI from Saturday, November 22 – Monday, November 24, 2025, including, but not limited to, activities including the Packers vs. Vikings game at Lambeau Field as well as any other organized group events or activities, such as group dinners, (the “Event”) and hereby assume all the risks and liability related to my participation in the Event. All dates, times, and locations of the Event shall be as set forth in the final itinerary. I understand and acknowledge that there are risks in traveling to and attending any sporting event, including potential exposure to viruses such as Covid-19 etc., and that there is the potential for me to incur bodily injury, death, or property loss during the travel to and attendance at the Event. With this understanding, in exchange for the opportunity to attend the Event, I hereby assume all the risks related to my participation in the Event. I acknowledge that the Event sponsors, including without limitation, Polaris Industries Inc. (“Polaris”) with its marketing agency, rEvolution Marketing LLC (“rEvolution”), assume no liability for the safety and actions of the individuals participating in the Event and understand that I AM PARTICIPATING AT MY OWN RISK AND AM RESPONSIBLE FOR ANY AND ALL DAMAGES.

Accordingly, in exchange for this and other valuable consideration, acting for myself and my heirs, administrators, beneficiaries and representatives, I hereby agree to indemnify, defend and hold harmless Polaris, rEvolution, and each of their respective predecessors, successors, parent companies, subsidiaries, and affiliates, and all present and former officers, directors, partners, principals, employees, attorneys, insurers, reinsurers, agents and assigns (all of the foregoing, the “Releasees”), from any and all claims, causes of action, suits, proceedings, debts, contracts, controversies, attorneys’ fees, court costs, claims, and damages, demands, whatsoever, whether past, present, or future, known or unknown, of any kind, nature or description, now existing or which may hereafter arise from any of the facts, acts, omissions, occurrences, events or circumstances now existing or to arise in the future based upon or relating to my travel to and from and attendance at the Event, including for claims of damages to persons or property caused during my attendance at the Event, whether such claims are based upon tort, negligence, breach of contract or any other theory of recovery and whether for compensatory or punitive damages or otherwise. I agree that neither Polaris nor rEvolution shall be liable for any direct, indirect, special, or consequential damage of any nature that I may suffer as a result of my participation in and attendance at the Event.

I am aware of, and understand, the provisions of California Civil Code Section 1542 (“Section 1542”), which provides: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” I expressly, knowingly, and intentionally waive any and all rights, benefits, and protections of Section 1542 and of any other state or federal statute or common law principle limiting the scope of a general release.

I agree that Polaris and rEvolution have my permission to use my name, picture, portrait, video recording, likeness and/or voice in any advertising or promotion materials in any media, whether online or offline, without further compensation (collectively, “Publicity Materials”). I waive any right I may have to inspect or approve the Publicity Materials, or the advertising or other copy that may be used in connection therewith or the use to which the Publicity Materials may be applied.

Polaris reserves the right to cancel the Event at any time, for any reason, without compensation to participants. Participants are representing the Polaris brand and are expected to act with decorum, observing all local laws, orders, rules and regulations (“Laws”), both of the municipality and the facility where the Event is occurring, and any violations of such Laws, in Polaris’ sole determination, may result in the immediate revocation of participant’s ability to continue attending the Event, resulting in the participant being asked to leave the Event.

I HEREBY AFFIRM THAT I AM EIGHTEEN (18) YEARS OF AGE OR OLDER, HAVE READ THIS DOCUMENT, AND UNDERSTAND ITS CONTENTS. I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES. THIS IS A COMPLETE AND FINAL RELEASE OF ALL CLAIMS. BY SIGNING THIS DOCUMENT I AM FOREVER GIVING UP SUBSTANTIAL RIGHTS. I HAVE FULLY READ AND UNDERSTAND THIS DOCUMENT BEFORE SIGNING.
